Build & Ship Service Terms
These terms apply to all Build & Ship orders placed with DC Additive Pros. By submitting a file and placing an order, you agree to these terms. Last updated: [date]. [Reviewed by counsel: date].
1. Who these terms are between
These terms are between you, the seller or customer placing the order, and DC Additive Pros, located in Rockville, MD. In these terms, "we" and "us" mean DC Additive Pros, and "you" means the customer.
2. Your role and our role
You are the creator of your product. You provide the design and file. We manufacture the product to your file and, when requested, ship it on your behalf. We do not design, originate, customize, or claim ownership of your product. We do not sell your product and we do not operate a marketplace that competes with you.
3. Rights to your design
You confirm that you own, or are properly licensed to use, all rights in the design and file you submit. You confirm that your design does not infringe any trademark, copyright, patent, or other right of any third party. We will not knowingly reproduce trademarked or copyrighted characters, logos, or other protected works. You agree to cover and hold us harmless from any claim, demand, or cost arising from a third party alleging that your design infringes their rights.
4. Files we will not produce, and our right to refuse
We may refuse any file or order at our sole discretion, with or without stating a reason. We will not produce, among other things: firearms or any firearm part or component, including frames, receivers, magazines, suppressors, or anything intended to function as part of a weapon; other weapons or items designed to injure; items that are unlawful to manufacture, possess, sell, or ship under federal, state, or local law; counterfeit items or items that infringe a third party's trademark, copyright, or patent; and any item we believe is unsafe or could expose us to liability. If we discover such content after an order has begun, we may stop production immediately and refund the unproduced portion. Refusing an order reflects our policy and legal limits, and is not a judgment about your design.
5. File accuracy is your responsibility, and we do not change your files
You are responsible for the accuracy and completeness of your file, model, measurements, tolerances, and specifications. We print the file you submit and approve, exactly as provided, and we ship it. We do not correct, modify, customize, redesign, or otherwise change your file, and we do not guarantee that your design will perform a particular function. If a correction is needed, you must make it and resubmit the file. All corrections are your responsibility.
6. File review and approval
Before production, a member of our team reviews your file for manufacturability and will point out issues we happen to notice. This review is a courtesy feasibility check only. It is not an engineering review, a fitness-for-purpose review, a guarantee that your file is free of errors, or an offer to fix anything. If our review identifies a problem, you make the correction and resubmit; we do not edit your file for you. You approve your file and quote before production. That approval is your acceptance that the product meets your requirements, and production proceeds on that basis. A physical sample is available if you want one, as a standard paid order at normal pricing.
7. Defects and remedies
If a product is defective due to our manufacturing error, we will remake the affected unit or refund its manufacturing cost, at our choice. If a defect, fit problem, or failure is caused by an error or omission in the file you supplied, or by a specification you approved, the correction and any reprint are billed to you. We will contact you to resolve file issues before anything ships whenever we can.
8. Limitation of liability
Products are made to your specification. We are not responsible for whether your design is fit for its intended use, safe for any particular application, or compliant with any law, regulation, or standard. To the fullest extent allowed by law, our total liability for any order is limited to the amount you paid us to manufacture the affected item. We are not liable for lost profits, lost sales, lost goodwill, or any indirect, incidental, or consequential damages.
9. No warranty beyond manufacturing
We warrant only that we will manufacture your approved file using sound production practice. We make no other warranty, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.
10. Material and care limits
Products should be kept within these limits: room temperature, refrigerator 2 to 8 C, or standard freezer -20 C. Products are not made for autoclave, dishwasher, or cryogenic use. You are responsible for confirming that the material and product are suitable for how you and your customers will use them.
11. Payment
Payment is due before production begins. We do not start production on unpaid orders.
12. Shipping, risk, and title
We ship from Rockville, MD, within the United States only. We do not ship internationally. Shipping is quoted once at onboarding by weight and region, then locked into your pricing profile and billed at actual carrier cost. Alaska and Hawaii carry a surcharge. On-demand orders ship blind, with no DC Additive Pros branding on the package.
We package every order appropriately for transit. Once we hand a package to the carrier, title and risk of loss pass to you, or to your customer for blind orders. From that point, we are not responsible for carrier delays, packages not received, lost or stolen shipments, or damage that occurs in transit. We provide tracking where available. Shipping insurance is available on request and billed as a pass-through cost. Claims for lost, late, or damaged shipments are made through the carrier, and we will provide the documentation you need to file a claim.
13. Turnaround
Our standard turnaround is 2 to 4 business days, measured from the time you approve your file and quote, and is subject to our current production queue. Some orders take longer, including complex or multi-part designs, certain materials and finishes, larger items, and high quantities. We give you a turnaround estimate at quote. Turnaround times are estimates, not guarantees.
14. Changes and cancellations
You may change or cancel an order before production begins. Once production has started, the order cannot be cancelled, and changes require a new quote.
15. Your files and confidentiality
We do not sell or share your files, and we do not use your design to compete with you. We retain your files only to fulfill your orders. We will delete your files on written request once you have no open or recurring orders.
16. Your platform compliance
You are responsible for your own compliance with the rules of any platform you sell on, including Etsy production-partner disclosure and any required origin or AI disclosures. We will provide the information you reasonably need to make those disclosures.
17. Governing law and disputes
These terms are governed by the laws of the State of Maryland, without regard to its conflict-of-law rules. If a dispute arises, both sides agree to first attempt to resolve it informally by contacting the other in writing and allowing thirty days to reach a resolution. If the dispute is not resolved, it will be brought exclusively in the state or federal courts located in Maryland, and both sides consent to the jurisdiction and venue of those courts. Each side is responsible for its own costs and attorney fees unless the law provides otherwise.
18. Changes to these terms
We may update these terms. The version in effect when you place your order applies to that order.
